  • Turn Signal Violations as a Cause of Car Accidents

    There are a lot of rules for driving that we all learn when studying for our driving exams. However, after getting your license and becoming an experienced driver, you often forget to continue driving in the manner you were taught. When driving, it is imperative to use your turn signal when making a turn or simply changing lanes. This helps to keep the driver and company safe along with those in other vehicles as well.

    Unfortunately, many do not use their signal when necessary. People improperly use or simply don’t use their signal for a number of different reasons, including forgetting to, being too lazy, not having enough time, having a broken signal (hand signals should be used instead in this case.) or even because they want to cut off another driver.

    People everywhere continuously violate this law. This problem is one that one of our own staff feels quite strongly about. It can become a major issue that causes an accident when a driver comes into a person’s lane and hits them after failing to use their turn signal. Not only is this violation dangerous, but it can also be costly and a major cause of car accidents.

    A ticket for not using your turn signal can be at minimum, around $100, if there is only one infraction. Unfortunately, if there are multiple infractions in one incident, these can be stacked. To stay safe and avoids these costs, take a look at a summary of the Arizona state traffic law for this issue listed below.

    • Before attempting to turn a vehicle, the driver must make the vehicle is in the proper position. To enter another road, driveway or otherwise turn a vehicle from one direction to another or just to change lanes on a roadway, the driver must also check to ensure their safety along with others on the road.
    • They must not complete the turn without a proper signal to other drivers, in case another vehicle may be affected by the change in traffic.

    While the main gist of the law is that use of a turn signal is required in the events mentioned above, there are other points regarding the law. Timing is important when it comes signal use and when a driver needs to quickly reduce speed is another event that requires this use.

    See these additional points regarding this traffic law below.

    • The law also states that a signal of whether the driver plans to turn left, or right should be made continuously throughout at least the last hundred feet that the car moved when required.
    • Also, the driver cannot make a sudden stop or decrease in their car’s speed unless they first five a signal to the driver of any vehicle that is immediately to their rear when they have the opportunity to do so.

    It is very easy for using a turn signal to seem very small in the bigger picture of maneuvering through traffic, but one small infraction could also impact numerous lives. As explained in the example of one of our law firm employees and the law outlined above, using your signal is imperative as a driver, so take heed.

    Although, it would be nice if our vehicles simply provided the turn signal for us, neglecting to use them ourselves is not worth the possible outcome of an accident. Be a diligent driver. Follow the law, and keep the roads safe for everyone, including yourself.
    While we hope this article will help to prevent accidents as a result of improper turn signal use, the professional car accident lawyers at Hutzler Law are here for any of your Arizona personal injury law needs.

  • 5 Driving Habits That Ruin Your Car

    Human beings and the society are flawed, so it is natural to make mistakes while we attempt to be perfectionists. Driving is fun, but it comes with great responsibility. We all break traffic rules – some of us more than others. Auto accidents are on the rise and wrongful deaths happen every day, but it’s a norm now so nobody pays attention. While habits like tailgating and going over the speed limit are mostly intentional (because we are willing to risk our lives), some of our involuntarily driving habits are busting our car under the hood. As a result, your car is deteriorating faster than it should, and a visit to the mechanic will be due much sooner than necessary. It is peak time for breaking the toxic habits and saving yourself a load of uncalled-for expenses.

    #1 Speeding over Potholes and Speed Bumps

    Some city streets just lack proper construction; few days of bad weather or the passage of a dozen heavy vehicles ruptures them within days. Nobody is eager to fix them anytime soon either, so the formed potholes keep getting bigger and deeper; sooner or later it gets impossible to avoid them, unless your car has wings. Driving right through the lacerations causes serious damage to the car’s alignment, suspension, and steering. Similarly, speed bumps are made to slow you down, so doing the opposite will not be fruitful. If your car drives in proximity to the ground, the lower body shall encounter massive wear and tear.

    #2 Keeping one hand on the Gearstick

    During Driver’s Ed, your instructor must have told you to keep both hands on the steering wheel at all times, so why don’t you? Many of us are accustomed to resting one hand on the gear shifter, which is a bad idea indeed. The gearstick is connected to selector fork that is supposed to stroke a rotating collar for short intervals. By placing our hand on the gearstick, we force the selector fork to remain in contact with the rotating collar for a long time, causing premature deterioration.

    #3 Driving on a Nearly Empty Tank

    Gasoline plays the role of a coolant in your car’s fuel system, so never let it dry out completely. Make sure to hit a gas station when the fuel gauge indicates that you’re running low. Do not assume that you are good for another 50 miles, as insufficient fuel can cause overheating and breakdown of various car parts. Keep you tank at least half full at all times to avoid any inconvenience.

    #4 Revving a Cold Engine

    Popular belief is that using your car to travel short distances only on a regular basis is awful for the machine because the engine oil stays cold (causing friction and erosion of metallic parts). On a practical note, all vehicles start at a low temperature, and revving the engine immediately is what causes the damage. When the car is powered off, the oil sinks to its lowest point. Therefore, start the car and wait 10 to 20 seconds before you set off; this will provide sufficient time for the oil to circulate and warm up the engine.

    #5 Slamming the Brake Pedal Downhill

    Driving down a steep road can be intimidating; so many drivers glue their foot to the brake pedal, as deceleration becomes easy. This puts too much pressure on the brake pads and rotors, which compromises the car’s stopping power. They will stop working after some time and require replacement. The superior alternative is to abandon the accelerator and shift to a lower gear. P.S: Lack of maintenance makes a car more prone to car accidents, so never ignore your dashboard lights. If you have suffered personal injuries or vehicle mutilation due to another party’s faulty car, contact a Car Accident King to help you recover damages.

  • Guidelines for Setting Up a Law Firm

    Starting your own Law office is a great idea if your entrepreneurial side is urging you to take charge. Whether you have been practicing law for some time or you just got out of Law College, you can do it! Experience matters, but no one said that it cannot be obtained from your personal business. You will succeed as long as you possess expertise in your chosen field, and can make yourself stand out in the competitive market.

    Build an Identity

    If you have not picked out a name for your law firm yet, remember to keep it simple. The name of your company must suggest your profession; do not choose a fancy word that has no connection to the law industry. Many businesses add words or phrases like ‘Law Firm’, ‘Attorneys’, or ‘Group of Lawyers’ at the end of their brand name for clarification.

    If you plan to focus on a single department of law such as ‘Criminal Defense’ or ‘Personal Injuries’, then it is best to include it in your brand or logo. This way the purpose of your establishment will be well-defined, and it shall get easier for potential clients to identify you.

    Many law startups fail because they ignore modern tools for emphasizing their existence. An online presence is crucial for every business today. The days for phone directories are long gone and clients are likely to find you on Google. Most people will contact you through your website or get your phone number/address from there to arrange a physical meeting.

    You website must be functional, regularly updated, and provide adequate information regarding your services. Choose your location wisely, preferably a commercial area in your district. Many people operate from home to cut down office costs, but it is not recommended, as it appears to be unprofessional.

    Manifest Self-reliance & Consistency

    Many people will discourage you down the road of setting up a private business. They will tell you to get a job for the sake of ‘financial stability’. The majority of these people have no experience managing a business, nor have they once tried being their own boss for a day. You will have to believe in yourself to achieve your business goals.

    You cannot start a firm without some capital at your disposal. Make sure you have enough to cover costs of your website, office rent & supplies, and employee salaries for a year. Establishing your company will take time and it could be several months before you make any profit. You must have a full thought out plan for running your business; this includes marketing strategies, financials, competitive advantages, and so on.

    Focus on the area of law where you excel and don’t welcome every case that comes at your door. It is important to stay true to your brand and avoid creating confusion. If you are a divorce lawyer, do not represent a case of criminal offense. The act may go against your reputation and form conflict among competitors.

    Getting Leads and Referrals

    Many law firms buy leads from third parties/online resources, which is a good option when your business sits in its initial stages. The good thing is that you get access to a plethora of cases that are relevant to your field, and the downside is that the competition is harsh. Fighting for the best personal injury leads, criminal defense leads, or medical malpractice leads can be severely challenging. At first, you may have to make-do with cases that are not exactly cost effective. Nonetheless, consider it as a learning process and use it to build an impressive portfolio.

    Making the right connections can speed up your progress and allow you to reach milestones in no time. Befriend people who are already practicing law; invite them for lunch, coffee, or drinks. Lawyers in your locality can give a boost to your business if you stay on their good side. If you come across a client suited to their niche, then refer them to him/her. They will gladly return the favor and will love to share their experiences if you show genuine interest.

  • Hiring an Experienced Attorney After a Slip and Fall Accident

    Slip and fall accidents happen too often that it’s important that you are aware of how an attorney can help you. These accidents may sound simple, but it can be a detriment to your health since worst cases show internal bleeding caused by the fall. So, it’s best to know what your options are and how an attorney can help after a slip and fall accident.

    What Is A Slip And Fall Accident?

    A slip and fall accident is a type of personal injury case wherein a person literally slips and falls on someone else’s property. However, just because a person slips in an owned property does not necessarily mean that the owner becomes liable for the damages.

    Slip and fall cases can be caused by a lot of things – a wet floor, a misplaced tile, or even poor lighting. Usually, when someone trips and falls on someone else’s property because of those reasons, then damages shall be awarded to the victim.

    How Does A Slip And Fall Case Work?

    Similar to most personal injury cases, the objective of a victim is to be compensated for the damages he has experienced that were caused by the slip and fall injury. On the other hand, the defendant’s objective is to prove that he was not negligent in doing his duty or to prove that the victim himself was negligent.

    The process starts when the plaintiff files a case against the defendant. Most of the time, the reason would be negligence. Then, the defendant is given his chance to prove that he is not the one who is guilty. This is when pieces of evidence and witnesses are shown in court. Depending on the case, this can take a longer time because of the gathering of solid evidence.

    The judge, in cases like this, follows the common law. Common law is the term that refers to the laws made by judges in previous cases. Common law and personal injury laws vary from one state to another so the outcome of your case may also vary. Nonetheless, when the defendant is proven guilty, damages shall be compensated to you.

    Why Hire An Attorney?

    Slip and fall cases sound simple enough that you would think that it can be defended by yourself at court. However, it’s not that simple as most cases are. Here are three reasons why you need a slip and fall attorney.

    1. They Are Experienced

    Slip and fall cases can become complicated without you knowing it. So, to prepare for moments like this, an experienced attorney should be hired in order to make your case flawless. The expertise of a slip and fall attorney will greatly help you defend yourself against the accusations and the defense of the other party.

    2.They Can Help In Negotiations

    Lawyers, ideally, are skilled in negotiations. In the event that the defendant tries to give a settlement, your lawyer will guide you in order for you to get the just compensation you need.

    3. They Will Gather Pieces Of Evidence And Witnesses

    Lastly, and the most important one, is to gather pieces of evidence including the witnesses. In order to prove that the defendant is at fault, the evidence should point to that. Circumstantial evidence might not hold strong at court, so you would need an attorney to set the facts straight and to show in a clear-cut manner that the defendant was negligent to his duties.

    Because of the costs of getting a slip and fall attorney, you might hesitate to hire one to defend your case. However, the advantages will outweigh the costs because there are cases when lawyers agree not to get paid until they win the case.

  • Understanding Catastrophic Injury Claims

    Any harm you suffer as the result of another party’s negligence is serious business, leading to lost work, stress, and expensive medical bills. However, in an event that a injury is very severe the legal profession places it in a special category called catastrophic injury. Catastrophic injuries are defined by their anticipated outcome rather than by the nature or type of injury. Some of these injuries render a person permanently incapable of working whereas others subject the individual to a lifetime of lowered immunity, mental disability, susceptibility to infection, and repeated surgeries or medical care.

    A catastrophic injury permanently transforms the victim’s life subjecting them to a permanent loss of income, a lifetime of expensive medical treatments and therapy, or both. If you suffer from a catastrophic injury, you may be entitled to receive medical benefits, vocational rehabilitative benefits, and total disability benefits for life under Worker’s Compensation laws.

    An example of a catastrophic injury would be a traumatic brain injury. Such injuries can be sustained in the range of mild to severe. In a mild brain injury loss of full conscious awareness may persist for some time. The majority of all reported traumatic brain injuries are the result of an automobile accident.

    Types of Catastrophic Injury

    Although any injury can theoretically become catastrophic, the law identifies some common types:

    • Traumatic brain injury causing periodic neurological disruption, severe sensory disturbances, or severely impaired motor function;
    • Severe spinal injury leading to paralysis;
    • An amputation;
    • Second- or third-degree burns;
    • Blindness

    Brain and spinal injuries are the most common catastrophic injuries because these areas of the body control movement in the extremities. Traumatic brain injury, even mild ones have the potential to deteriorate over time, and it is especially important to seek proper medical care immediately after receiving a blow to the head.

    Severe burns are another category of catastrophic injury. When an individual receives burns, they may require multiple skin grafts and surgeries. The burn can reach beneath the skin to damage underlying bone and tissue. A victim’s lungs may become so severely scarred that they develop diseases like emphysema or chronic obstructive pulmonary disease. The pain and trauma from the event can lead to post traumatic stress disorder and impaired mental function.

    Seeking Damages as the Result of a Catastrophic Injury

    In order to recover damages, you must establish that your injury is severe enough to prevent you from performing the job you previously held or any work available in the national economy for which you are qualified. You will need to provide substantial proof that you require ongoing medical attention and that you are vocationally handicapped.

    In some cases, workplace conditions may be responsible for your catastrophic injury. An experienced personal injury lawyer can help you determine when to file a claim, what sort of damages you may be entitled to, and whether you meet the requirements under state law. They will also be able to determine whether you have filed within the proper period of time.

  • 7 essential Tips to reduce car accidents while on job

    There are many steps and preventions that can be taken to reduce the chance of road accidents according to Car Accident Lawyer Colorado Springs. Following are the steps that you must consider in order to reduce fleet accidents at work.

    The driver should be well informed

    If your driver is busy elsewhere your accident reducing strategy probably won’t work. Your driver must know how to behave on the road. He must check the regular maintenance of the vehicle in addition to this he must be aware of to do actions right after a collision.
